If you are a graduate of a Polish university and your studies have been completed and you have received a diploma, you can apply for a temporary residence permit due to other circumstances.
This applies to the situation if you are a graduate of a Polish university and are looking for work in the territory of the Republic of Poland or plan to start business activity in this territory.
The above-mentioned permit is granted for a period of 9 months, once and immediately after graduation.
As a general rule, a residence permit for graduates of Polish universities is granted if the circumstances which are the basis for applying for this permit justify the foreigner’s stay in the territory of the Republic of Poland for a period longer than 3 months.
LEGAL BASIS:
Art. 186 sec. 1 point 6 of the Act of 12 December 2013 on foreigners (Journal of Laws of 2020, item 35).
Regulation of the Minister of the Interior and Administration on the number of funds that a foreigner who intends to undertake or continue education on the territory of the Republic of Poland, or a foreigner looking for a job or planning to start a business activity, who is a graduate of a Polish university or has completed scientific research, or development works on the territory of the Republic of Poland of April 16, 2019.

Missing any of the above documents will result in the call of the foreigner to its supplementation within not less than 7 days from the delivery of the request under the pain of leaving the application without examination.
TYPICAL DOCUMENTS SUPPORTING THE CIRCUMSTANCES INDICATED IN THE APPLICATION:
Remember: Attaching all the documents listed below to the application when submitting it may reduce the amount of official correspondence and shorten the time of handling the case.
- Diploma of graduation from a Polish university.
- Documents confirming the possession of health insurance within the meaning of the Act of 27 August 2004 on health care services financed from public funds or confirmation that the insurer covers the costs of treatment in the territory of the Republic of Poland.
- Documents proving sufficient financial resources to cover the costs of living and return. (for a single person running more than PLN 701 net per month, and for a person in a family – more than PLN 528 net per month).
- Documents proving sufficient financial resources to cover the costs of return travel to the country of origin or residence or the costs of transit to a third country granting the entry permit, not less than:
- PLN 200, if it came from a country neighboring the Republic of Poland,
- PLN 500, if it comes from a non-neighboring European Union Member State
with the Republic of Poland or a member state of the European Agreement
on Free Trade (EFTA) – parties to the agreement on the European Economic Area or with the Swiss Confederation,
- PLN 2,500, if he came from a country other than those mentioned in the above points,
- or the equivalent of these amounts in foreign currencies.
A foreigner who came to the territory of the Republic of Poland or stays in this territory with family members dependent on him, must have financial means for each family member to cover the costs of return travel to the country of origin or residence or the costs of transit to a third country that will grant the permit on entry
- A document confirming the possession of a secured place of residence (eg a rental agreement for a flat, another agreement enabling the owner of a flat, or a declaration of the person authorized to use a flat about providing the foreigner with a place of residence).
If there is a need to clarify or clarify the evidence held by the authority
in the case, the foreigner may be called in the course of the proceedings to provide other documents or to testify confirming the circumstances referred to in the application.

RIGHT TO PERFORM WORK
This permit does not grant the right to work in Poland. In order to take up employment, you must additionally obtain a work permit, unless it is not required.
Graduates of full-time studies at Polish universities are exempt from the obligation to obtain a work permit.
A foreigner who is a full-time student in Poland is exempt from the obligation to obtain a work permit, regardless of whether he or she studies at a public or private university.
Therefore, exemption from the obligation to have a work permit does not apply to foreigners who are part-time students (extramural, evening, extramural, etc.).
DEADLINE FOR PROCESSING THE CASE:
In connection with the obligation to request information from the commanding officer of the Border Guard branch, the provincial Police commander, the Head of the Internal Security Agency, and, if necessary, also the consul or other authorities, whether the foreigner’s entry into the territory of the Republic of Poland and his stay in this territory may constitute a threat to defense or security state or the protection of public safety and order, who are obliged to provide the above-mentioned information within 30 days from the receipt of the request, it is probable that the decision on granting the permit will be issued only after 1 month from the date of initiation of the procedure.
Practice shows that most applications are processed within two to three months, depending on the local authority.
SUBMISSION OF APPEALS FROM THE DECISION:
The written appeal should be submitted by post or at the office of the Voivodeship Office, within 14 days from the date of delivery of the decision.
Appeals should be addressed to the Head of the Office for Foreigners through the Voivode who examined your application.
The foreigner submits the application to the voivode competent for the place of his stay.
The application is submitted by a foreigner applying for a permit in person, no later than
on the last day of legal stay on the territory of the Republic of Poland.
When submitting the application, the foreigner is required to submit fingerprints.
If the application is not submitted in person or is sent by post – after the application has been delivered to the voivode, the foreigner will be requested to appear in person within not less than 7 days from the delivery of the summons, otherwise, the application will not be examined.
Only a foreigner is a party to the proceedings in the procedure for granting a temporary residence permit.
