The issue of the stay of US citizens on the territory of the Republic of Poland was regulated by an agreement in the form of an exchange of notes between the Government of the Republic of Poland and the United States Government on the waiver of visas for US citizens of April 4, 1991.
According to the provisions of the above The agreement abolished the visa requirement for US citizens when traveling to Poland for a period not exceeding 90 days.
On the basis of the interpretation of the above regulations by the Ministry of Foreign Affairs and adopted by the Border Guard, leaving the territory of the Republic of Poland by a US citizen before the end of the 90-day period of stay, may take place for another Schengen country (provided that the stay of a US citizen in that country is legal) or a third country . The very important is fact of crossing the border of the Republic of Poland and staying at least one day on the territory of another country. Evidence confirming the fact that a US citizen has left the territory of the Republic of Poland before the end of the 90-day period of stay may be a stamp of border control in a travel document – in the case of departure to a country outside the Schengen area (e.g. Ukraine, Great Britain, Ireland etc.) or possession of documents confirming the fact of the foreigner’s stay on the territory of another country – in the case of departure to a Schengen state (e.g. personal invoice for a hotel stay).
Thus, the stay of such a person on the territory of the Republic of Poland is always counted separately from the stay on the territory of the other Schengen states – where the allowed short-stay in visa-free travel can be exhausted due to exceeding the limit of 90 days of stay in the period of 180 days counted backwards, i.e. since the first entry into the territory of the Schengen countries (deriving from the provisions of Regulation (EU) No 2018/1806 of the European Parliament and of the Council of 14 November 2018 listing third countries whose nationals must be in possession of visas when crossing the external borders, and those whose nationals are exempted from this requirement).
After re-entering the territory of the Republic of Poland, a US citizen is always entitled to another stay for a period not exceeding 90 days. Subsequent periods of stay are counted from the beginning and are not limited by a semi-annual or annual time limit. There is also no limit to the repetition of 90-day periods of stay of US citizens on the territory of the Republic of Poland.

It should be remembered that during the announced epidemiological status in Poland, special regulations apply to entry into the territory of the Republic of Poland. to the temporary reintroduction of border control and the introduction of epidemic status on the territory of the Republic of Poland, the border for entry to Poland may cross only:
– Polish citizens;
– foreigners who are spouses or children of Polish citizens or stay under the constant care of Polish citizens;
– foreigners holding a Card of Pole;
– heads of diplomatic missions and members of the mission’s diplomatic and consular staff, i.e. persons with a diplomatic rank and members of their families;
– foreigners who have the right of permanent or temporary residence on the territory of the Republic of Poland, i.e.
a) persons holding a residence card issued due to possession of:
- temporary residence permit,
- permanent residence permit,
- long term EU residence permit,
- permission to stay for humanitarian grounds
- refugee status
- subsidiary protection
b) persons possessing:
- certificate of registration of stay of the EU citizens
- permanent residence card of a EU citizen
- residence card of the family member of an EU citizen,
- permanent residence card of a family member of an EU citizen,
– the foreigners possessing a right to work on the territory of the Republic of Poland i.e. the foreigners entitled to work on the same grounds as Polish citizens, the foreigners possessing work permits, work permits for a seasonal work, certificates on registration for seasonal work, declarations on entrusting the work on the territory of the Republic of Poland who:
- currently work on the territory of Poland,
- are able to present documents which confirms that they will start work shortly after entry to Poland,
– the foreigners who run a means of transport for the transport of persons or goods, and their passing takes place as part of their professional activities related to transport of goods or the transport of persons
